As you may imagine, theft crimes are extremely common. There are also a wide variety of theft crimes. From retail theft to receiving stolen property, all the way to fraud and embezzlement. The Pennsylvania crimes code outlaws dozens of forms of theft. Each one of these crimes requires special attention to the elements of that particular charge. There are also multiple ways to defend a theft crime, from making restitution to crafting a lack of knowledge defense. For example, retail thefts are a very common form of theft crime. A typical scenario involves someone attempting to leave a store or retail outlet with an item that they have not paid for. If caught, the person committing the theft could face anything from a low-level summary offense to a felony retail theft charge. The grading of the crime depends on the quantity and value of the alleged stolen items. In cases where the stolen goods are very low in value, our law firm can often negotiate a full dismissal if the offender completes a series of retail theft courses. This is an optimal solution. In cases where the value of the goods is high, the retail theft courses may not be an option. Regardless, for people with no prior offenses or just minor prior offenses, there are diversionary programs that can result in a dismissal of the case and the protection of that person’s criminal background. Careful guidance is required every step of the way.

In cases where a more serious type of theft has been committed, a more aggressive approach may be necessary. First, our firm may seek a dismissal or reduction in charges if the accused is able to pay back the value of the stolen goods. This is called restitution. Sometimes the individual charged was not the only party to the crime or perhaps they had no intent to steal.
